Abstract (in inglese)
The essay aims to verify the impact of the new Supplementary Rules of 2020 on adversarial system in the context of the incidental judgment of constitutional legitimacy. In this regard, the influence that the new institution of amicus curiae may exert in concrete is firstly taken into account. Secondly, the constant and renewed orientation of constitutional jurisprudence restricting the scope of third-party intervention in some particular cases is questioned. Starting right from the new regulatory framework, it is thus proposed a limited expansion of the adversarial system expressing a logic of openness consistent with the nature and function of incidental judgment.
